This complaint from 3Shape asserts patent infringement in relation to its intraoral scanning technology.
3Shape has announced that it has filed a complaint against Carestream Dental. This complaint is in relation to its intraoral scanners and features of wireless scanning, tooth color shade measurement, and the use of the handheld scanner wand as a remote control, according to a press release from 3Shape.
According to 3Shape’s complaint, certain intraoral scanner models such as the CS 3700 and CS 3800, infringe a 3Shape patent relating to tooth color shade measurement. It also asserts that the CS 3800 infringes all 3 patents, with one covering the wireless scanning technology.
This complaint was filed in the United States District Court for the Western District of Texas. Head of Litigation and Compliance at 3Shape Thomas Kirkbak said that this complaint was done to protect the technology from infringement.
“3Shape TRIOS has received the Best of Class award for intraoral scanners an unprecedented 9 years in a row. Our innovation and scanner technology are unique and fundamental to why we are the choice of doctors,” Kirkbak said in the press release. “We simply cannot allow competitors to copy our hard-earned technology and infringe on our patents.”
The patents in question are 3Shape U.S. Patent No. 10,695,151, and U.S. Patent No. 11,076,146. The complaint will seek monetary damages and injunctive relief.
